Agricultural Districts

Article 25-AA of the New York State Agriculture and Markets Law authorizes the creation of local agricultural districts pursuant to landowner initiative, preliminary county review, state certification, and county adoption. The purpose of the Agricultural Districts Program is to encourage the continued use of farmland for agricultural production. The Program achieves this purpose by providing a combination of landowner incentives and protections, all of which are intended to preclude the conversion of farmland to non-agricultural uses.

The following lists the benefits received by properties in an agricultural district:

  • Agricultural Assessment - Land used in agricultural production qualifies for an agricultural assessment on their property taxes.
  • Limitation on Local Regulation - Prohibits local government from enacting local laws or ordinances within an agricultural district that would unreasonably restrict or regulate farm operations, unless such regulations or restrictions are for the public health and safety.
  • Right to Farm - Authorizes the Commissioner of The Department of Agriculture and Markets to issue, by request, opinions as to whether or not particular agricultural practices are sound. Also requires a landowner in an agricultural district who is selling land to disclose to the buyer that the property is in an agricultural district.
  • Policy of State Agencies - Requires that the policies of all state agencies encourage the maintenance of viable farming in agricultural districts.
  • Limitation on the Exercise of Eminent Domain and Other Public Acquisitions - Requires any state or local agency or government which intends to acquire land, or which intends to construct or fund the construction of dwellings, commercial or industrial facilities, water or sewer facilities to serve non-farm structures, to use all practicable means in undertaking the action to minimize or avoid adverse impacts on agriculture.
  • Agricultural Data Statement - Requires an application for certain zoning and planning actions to include an Agricultural Data Statement as part of the review process.
